Parties ask to push off Monday non-jury trial due to settlement talks, scheduled deposition

The parties in a non-jury trial set to begin Monday have asked Madison County Circuit Judge Andreas Matoesian to continue.

Plaintiff Justin McElroy is suing Elvis Flowers for damages in excess of $50,000.

He claims that he was injured when Flowers failed to properly stop at a two-way stop near the intersection of 25th and Adams streets in Granite City in October 2008.

The suit’s non-jury trial had been slated to begin Monday at 9 a.m.
However, McElroy filed a motion May 5 asking Matoesian to push back the trial.

According to the motion, the parties are currently in disagreement about a possible settlement in the case.

They have also scheduled the deposition of a chiropractor to be taken in the near future.

The motion does not give a new trial date in the case.

The case is Madison case number 10-L-020.
