Edwardsville deck fall case goes to trial Monday

Madison County Circuit Judge Daniel Stack is set to preside over a negligence trial Monday involving a man who fell off a deck at an Edwardsville home he was visiting.

Plaintiff Michael Strong is suing Walter Haire and the Walter Haire Living Trust for at least $50,000 per count and costs.

According to his complaint, while on the home’s deck, he fell off and was injured due to what he claims was a faulty railing.

Strong alleges that the defendants were negligent in failing to maintain the railing, failing to warn him of the danger and improperly maintaining the deck.

He is suing for damages on the grounds of pain, suffering, lost income, mental anguish and medical bills.

The trial is scheduled to begin at 9 a.m.

Strong is represented by William Mateyka.

Walter Haire and the trust are represented by Martin Morrissey.

A third defendant, Mary Bailey, was dismissed in July 2008.

The case is Madison case number 08-L-336.
