Michigan claimant files asbestos suit in Madison County

A Michigan woman has filed an asbestos suit on behalf of her deceased husband against 41 defendant corporations, claiming the mesothelioma with which her husband was diagnosed was wrongfully caused.

Geraldine Seavoy claims Daniel L. Seavoy died from the disease Jan. 13, according to a lawsuit filed Sept. 3.

Geraldine says her husband worked from 1960 until 1995 as a millwright and maintenance supervisor at Celotex Corporation in L'Anse, Mich., according to the lawsuit.

She also claims Daniel worked from 1957 until 1959 as a deckhand at Wilson Trust in Great Lakes, Ill., and from 1960 until 1999 as an assembly line worker, freight car unloading, maintenance, plant mechanic and maintenance supervisor at Calotex Corporation in L'Anse.

Geraldines states Daniel's exposure was foreseeable and should have been anticipated by the defendants, according to the lawsuit.

She claims his disease was caused after he was exposed to and inhaled, ingested or otherwise absorbed asbestos fibers.

Geraldine alleges the asbestos-related disease caused Daniel to spend large amounts on medical care. She also says Daniel experienced great physical pain and mental anguish as a result of the disease, Geraldine claims in the lawsuit.

Mesothelioma hindered and prevented Daniel from pursuing his normal course of employment, according to the suit.

As a result, he lost large sums of money, Geraldine claims.

Daniel's family has spent large amounts of money on funeral and burial expenses, has been deprived of his means of support and has lost his society, the suit states.

Geraldine claims she has also been deprived of the companionship, society and services of Daniel.

In the six-count lawsuit, Geraldine seeks sums in excess of $150,000, economic damages which will reasonably compensate for Daniel's injuries, punitive and exemplary damages in excess of $50,000 and compensatory damages in excess of $100,000.

She also seeks punitive damages in an amount sufficient to punish Sprinkmann Insulation, Inc., and Sprinkmann Sons Corporation for their misconduct and to deter similarly situated parties from committing like acts of misconduct in the future.

She is represented by Randy L. Gori of Gori, Julian & Associates in East Alton.
