Union Pacific worker claims exposure to carcinogens led to lung cancer

A former railroad worker claims he developed lung cancer after his exposure to various carcinogens, such as second-hand cigarette smoke, diesel exhaust and asbestos, throughout his career.

Edmund Borgman filed a lawsuit July 19 in St. Clair County Circuit Court against Union Pacific Railroad Company.

In his complaint, Borgman alleges he was exposed to various toxic substances throughout his career from 1959 until 1968 in the clerical department at Union Pacific. In turn, he developed lung cancer, the suit states.

Due to his lung cancer, Borgman suffered great pain and disability, endured mental anguish and extreme nervousness and experienced disability, according to the complaint.

Borgman blames Union Pacific for causing his injuries, saying it negligently failed to provide him with a safe place to work, failed to provide him with safe equipment, exposed him to various toxic substances, failed to warn him of the dangers of the substances and allowed unsafe work practices to become common.

In his complaint, Borgman seeks a judgment of more than $50,000, plus costs.

William P. Gavin of Gavin Law Firm in Belleville will be representing him.

St. Clair County Circuit Court case number: 13-L-375.
