Roxana police blamed for stepping on bystander's hand during arrest

A Roxana woman has filed suit against the town’s police department, alleging police stepped on her hand during a raid conducted to apprehend a criminal.


Ashton Luck filed a lawsuit March 20 in the Madison County Circuit Court against the village of Roxana.

According to the complaint, Luck was in her home when police raided it to apprehend a suspected criminal on March 20, 2013. Although Luck was not the suspect, law enforcement officers forced her to the ground and stepped on her extended right hand, according to the complaint.

Because of the incident, Luck sustained severe injuries to her right hand and wrist, suffered mental pain and incurred medical costs, the suit states. She also lost money, the complaint says.

Luck blames the village of Roxana and its officers for causing her injuries, saying they failed to conduct the arrest in a safe manner, failed to control bodily movements, failed to keep a proper lookout for bystanders during an arrest and stepped on the hand of a bystander.

Luck is seeking a judgment of more than $100,000, plus costs. She is being represented by Samuel A. Mormino Jr. of Mormino, Velloff and Snider in Alton.
